1. AGREEMENT & ELIGIBILITY
Booking with Jagadamba Holidays Private Limited constitutes a legally binding agreement. By booking or making payment, the customer accepts these Terms & Conditions, the confirmed itinerary and applicable trip information. The contract is governed by the laws of Nepal. Travelers under 18 must be accompanied by a parent, legal guardian or authorized adult. All customers must meet the fitness requirements of their chosen trip.
2. PACKAGE SERVICES & BOOKING
A booking is confirmed only after the required payment and written confirmation from Jagadamba Holidays. Customers must provide complete and accurate personal, passport and travel information. Inclusions and exclusions are stated in the confirmed itinerary. Services may include accommodation, meals, transportation, guides, porters, flights, permits, TIMS and entrance fees as specified. Personal expenses, beverages, insurance and unlisted services are excluded. Advance and last-minute bookings are subject to availability and applicable payment requirements.
3. PRICE & PAYMENT
Prices are quoted per person in USD unless otherwise stated and may change before confirmation due to airfare, fuel, exchange rates, taxes, permits, supplier costs or operational changes. A non-refundable deposit is required to confirm a booking; final payment is due according to the confirmed booking conditions. Bank charges, exchange differences and payment shortfalls are the customer's responsibility. Credit-card payments incur a 4% surcharge. Small-group surcharges may apply where minimum numbers are not reached.
4. AMENDMENTS & TRANSFERS
Changes to confirmed arrangements must be requested in writing and are subject to availability. A USD 100 administration fee may apply, plus any additional airfare, accommodation, permit, supplier or operational costs. Transfers to another trip are subject to availability and applicable charges. Transfer of a booking from one person to another is not permitted.
5. CANCELLATION & REFUND
Any customer cancellation must be made in writing and acknowledged by Jagadamba Holidays. Cancellation charges are calculated on the total trip price per person:

No-show or departure without notice is 100% non-refundable. Non-refundable airfare, permits, hotel deposits, supplier charges or other unrecoverable costs may also apply where applicable. Customers are strongly advised to obtain trip cancellation insurance.
6. COMPANY CANCELLATION & FORCE MAJEURE
Jagadamba Holidays may cancel, postpone, suspend or modify a trip due to force majeure, natural disaster, war, political unrest, government restrictions, unsafe conditions, flight disruption or other circumstances beyond the Company's reasonable control. Where a Company cancellation applies, an alternative trip or refund of recoverable amounts may be offered, subject to non-refundable costs. The Company is not responsible for incidental or consequential expenses such as visas, insurance, flights, equipment or other personal costs.
7. ITINERARY, ROUTES & FLIGHTS
The itinerary is a planned program and is not an absolute guarantee. The Company reserves the right to alter, reverse, substitute, postpone or cancel routes, hotels, transportation, activities or schedules when reasonably necessary for safety, weather, operational or governmental reasons. Mountain flights are weather-dependent. Customers are responsible for additional costs arising from delays, cancellations or missed connections. The Company will assist with alternative arrangements where reasonably possible.
8. PASSPORTS, VISAS & PERMITS
Customers are responsible for valid passports, visas, permits and required travel documents. A passport with at least 6 months' validity is generally required. Jagadamba Holidays may assist with visa and permit processing but cannot guarantee approval, issuance or entry. Any costs or losses resulting from incorrect, incomplete or insufficient documentation are the customer's responsibility.
9. FITNESS, MEDICAL & ADVENTURE RISKS
Customers must be physically and mentally fit and must disclose any medical condition, disability or other condition that may affect participation. Remote and high-altitude travel may involve limited medical facilities and risks including illness, injury, altitude-related problems and emergency evacuation. The Company may refuse or terminate participation where a customer's condition or conduct reasonably creates a safety risk.
10. INSURANCE & EMERGENCY EVACUATION
Adequate travel and cancellation insurance is compulsory. Insurance should cover medical treatment, emergency evacuation/helicopter rescue, repatriation, trip cancellation, delays, baggage and equipment loss or damage, and personal liability. Customers must provide proof of insurance when requested. Insurance, medical and evacuation costs remain the customer's responsibility unless covered by the insurer.
11. GUIDE & CUSTOMER RESPONSIBILITIES
Customers must follow the reasonable instructions of the Company's guide or trip leader. The guide's decision concerning safety, conduct, route and continuation is final. A participant may be removed where health, conduct or behavior creates a safety risk, without refund for unused services. Customers are responsible for appropriate clothing, equipment, documents, insurance and preparation and must respect staff, guides, local communities and fellow travelers. Smoking and drinking onboard Company vehicles is prohibited. Unlawful, abusive or seriously disruptive conduct may result in removal without refund.
12. UNUSED SERVICES & SPECIAL REQUESTS
No refund, discount or credit will be provided for accommodation, meals, transportation, activities, permits or other services missed, unused or terminated voluntarily or involuntarily, including early departure, sickness or personal circumstances, except where required by applicable law. Special requests, including dietary or accommodation preferences, should be made in advance and are subject to availability unless confirmed in writing.
13. LIABILITY, COMPLAINTS, PRIVACY & PHOTOGRAPHY
Jagadamba Holidays will exercise reasonable care in providing contracted services but is not responsible for loss, delay, injury, cancellation or additional expense caused by circumstances beyond its reasonable control, including weather, natural disasters, road blockage, political conditions, government action, illness or flight disruption. The Company is not liable for incidental or consequential losses arising from such events. Nothing herein excludes or limits liability that cannot legally be excluded under Nepalese law.
Problems should be reported immediately to the guide, supplier or Company representative; unresolved complaints should be submitted promptly in writing. Customer information may be shared with authorized suppliers, agents, airlines, hotels or authorities where necessary for travel arrangements, visas or permits. Unless the customer objects in writing, photographs/videos taken during a trip may be used for Company promotional purposes.
14. ACCEPTANCE, UPDATES & JURISDICTION
These Terms & Conditions, the confirmed itinerary and booking information form the holiday contract. By booking or making payment, the customer confirms acceptance. Jagadamba Holidays reserves the right to update these Terms; the latest version published on the Company's website applies to future bookings. Any dispute shall be governed by Nepalese law and subject to the jurisdiction of the competent courts in Kathmandu, Nepal, to the extent permitted by applicable law.
